Contract Manager & Ethics and Data Privacy (ref 173)

Contract activities

Provide direct support to the Project teams and Company in bidding/ negotiating, awarding and administering some of the contracts for the Project and for the Company.

  • Prepare responses to queries raised by the Clients, the Contractor(s), and developing and managing a system for expediting responses to letters/ mails raised by Clients /Contractors;
  • Comprehensive administration of the contract of the project/ services, ensuring the parties properly fulfil their obligations and responsibilities in a fully auditable manner. This includes but is not limited to; 
  • Proper handling of correspondence, notices and communication, change proposals/ requests, change orders, and compliance with all approval limitations; 
  • Contract amendments and all other relevant matters so as to ensure full compliance with the contract itself, and all applicable project, regulatory and corporate requirements; 
  • Administer and monitor the provision and validity of all securities and guarantees provided under the terms of the Contract;
  • Proactive/ hands-on identification of potential changes and claims, and taking a steering role in developing/ implementing appropriate action to ensure the project/Company’s best interests are properly safeguarded at all times. Continuous interaction with the project team or with the Purchasing Team and with Clients/Contractors in this regard;
  • Day-to-day reporting/ accountability for ensuring Project Management is kept fully informed regarding all matters relating to the contracts and for key matters to the Company Direction’s team;
  • Act as the primary source of consultation for the Project/ Sales Team regarding interpretation of the Contract or application of measures under the contract. Lead and monitor the resolution of issues between the Company and Client/ Contractor;
  • Develop and implement in conjunction with the Heads of Product an effective claims mitigation strategy, process and system to safeguard and protect the company’s position; 
  • Coordinate or support the contract drafting, reviews and approvals, bid slate development, contract bidding, evaluations, negotiations and award recommendation;
  • Consult on Contract interpretation;
  • Generally works independently, but is supported by other contracting, legal, Tax & Insurance resources within Tractebel Group; 
  • Assist with opening and closing of Branch; 
  • Implement Group and Tractebel Policies and tools; develop local procedures and templates; 
  • Review and determine the adequacy of the commercial terms of all PO’s with respect to assignment (if applicable), warranty, securities and indemnities from the position of Company and alignment with the terms of the contract. Coordinate with the Purchaser Officer; 
  • Ensure relative discipline work is completed in compliance with project safety policies and procedures. Be an active participant in the Project Safety Program and in achieving Safety Goals. 

Ethics & Compliance activities

  • Implement Group and Tractebel Policies;
  • Prepare all reports, risk assessments, ethics checks, action plans and follow up;
  • Manage ethics incidents; 
  • Organize trainings, awareness and follow up attendance; 
  • Participate in audits and certifications. 

Data Privacy activities

  • Implement Group and Tractebel Policies and procedures; develop local procedures;
  • Maintain a data processing monitoring tool; 
  • Ensure compliance under local laws (including GDPR) of all DP processing activities;
  • Prepare all reports, risk assessments, action plans and follow up;
  • Organize trainings and awareness; 
  • Manage data breaches;
  • Implement Group and Tractebel Policies and procedures; develop local procedures;
  • Maintain a data processing monitoring tool; 
  • Ensure compliance under local laws (including GDPR) of all DP processing activities; 
  • Prepare all reports, risk assessments, action plans and follow up; 
  • Organize trainings and awareness; 
  • Manage data breaches.  

Your profile

  • Level of experience: 10 years of experience in the industry and or Infrastructure and or Engineering Consultancy. Contracting experience with Public sector is desired; 
  • Education background: Minimum Bachelor degree in pre-law, law or in business or Economics; 
  • Behavioral skills: assertive, negotiation skills, at ease in communication, well organised and structured (process), pro-active, business risk identifier, team minded; 
  • Language: NL + ENG advanced level mandatory, French is a plus.
